What is the process under the hood when you send the I-485 application? Does USCIS look through every page before sending out the receipt?
Form I-485 Process -When you send Form I-485 to the USCIS, they will first review it to make sure that there are no fatal errors (i.e. no signature, missing pages, etc)If everything is correct, they will cash the checks and being to process the application.Throughout the application process, they may need additional evidence. For example, if your sponsor makes below 125 percent of the federal poverty line or if their financial affidavit is unclear, the USCIS may mail you a letter or Form I-797, a request for additional evidence (RFE). This is a normal part of the process and happens to many application, so don’t be worried. You should, however, take them very seriously. If you submit your RFE response packet incorrectly, your I-485 will be rejected and you will have to start over.Once the forms have all the required evidence, the applicant will be required to go to their local USICS office for the biometrics appointment. This is a short appointment where your fingerprints and photos will be taken. After this, you will have your interview. Here a USICS officer will give your I-485 one last looks. If all is well, they will approve your case, and you will get your green card shortly! Congrats!Note: Make sure to fill out your application correctly and accurately to avoid REFs and rejection. Here is a step-by-step guide on how to fill out the I-485.
Can we convert an H4 visa to an F1 visa?
In general, it is possible to change status from H-4 to F-1 provided that you have the appropriate (I-20) documentation from the school you intend to attend.Note that H-4 is a dual intent visa, but F-1 is not, as a result, you may be denied the change of status if USCIS concludes that you have immigrant intent.Note also that change of status only applies while you are in the United States. If you are not in the United States and have a currently valid H-4 visa, but wish to obtain an F-1 visa, you must simply apply for an (entirely new) F-1 visa. While you can reuse some of the documentary evidence you collected for the H-4 visa for the F-1 application, it will be a new application.

PDF may be the dominant format for sharing print-perfect documents, but it's not ideal for filling out forms. The better solution is to convert PDF forms to HTML forms so the form can be viewed in any web browser and filled out on any device. The challenge a consumer faces is how to convert a PDF to HTML without losing the integrity of the original PDF.Although I don't intend to pitch my company on Quora, I do want to inform you that my company uniquely converts PDFs into HTML forms that can be filled out, saved to PDF (for printing and archiving), e-signed and electronically submitted. We are already working with a customer for a large number of immigration forms and can equally help anyone automate their forms.
What is the form I-797 and how should you fill it in?
I-797 is actually 6 forms. I-797 A,B,C,D,E,F. You as an applicant I presume will not have to fill out either version. USCIS provides either one, often more than one at the same time and represents a notice of action in response to your application.I797C, which represents recept of your application , it can also be issued as a copy of approval provided to the employer for their reference.I797B, which is a notice of the action of your first time H1B or I40 application (I797B). This typically means that your application is approved.I797A, which is a notice of action of your application to extend your status(I797A), similar to I797B.The I797 A and B looks basically the same except A would have an I94 attached to it. Typically I797B is provided when you are outside USA or your extension of status is not approved but your change of status is approved. Then there is I797D, which is accompanied by benefits card.I797E, which is basically a notice of action with a request for evidence.I797F, which is a transportation letter, issued overseas to allow applicants to travel.Note: I am not a lawyer and can not prlegal advice. I just know some of these from experience.Attached is a picture of I797A, that I found online from google.Image courtesy google [1]Footnotes[1] Redirect Notice
How exactly does H-1B petition works and how does cap affect the applicants?
It is a complicated process but here I will highlight the main steps in an informal way and which is relevant to Indians having a job offer in USA.First and foremost your employer files the petition. Thus, if you change your job, your new employer has to file a new petition for you. The US Citizenship and Immigration Services (USCIS) asks for your role and date of joining from the employer. The employer has to file the Labor Certification Application (LCA). In this, they have to basically state they will premployees on H1B the same compensation and benefits as other employees.Once the LCA is approved, the Department of Labor returns a certified copy to the employer. After this your employer files the H1B petition. For this it requires all the information regarding your education, memberships, community services, etc. Here the employer includes the fees and form I-129.After this you have to wait for the petition to be approved. This may take a long while depending upon the employer. If the employer pushes hard, it could take less time. Also here is where premium processing comes into play. The US government charges an additional $1,225 for premium processing in which case the petition has to be processed within 15 days. After this I got a mail which said:"Hello Abhik,Great News! The H-1B petition filed by Microsoft on your behalf has been approved! "At this point you should be pretty confident of getting your Visa. Once the petition is approved by USCIS, an approval notice, form I-797 is issued to the employer. This contains the time period of validity of the H1B visa, i.e., how long you can work in USA. (It is typically 3 years and can be renewed.)After this you just have to apply to one of the US embassies in India for an interview date. For this you need to fill a form called DS-160 and pay the interview fees. After this your passport is stamped with the H1B Visa,The Visa cap is fixed for every country. It is given out in a first come first serve basis. Many companies, most notably Microsoft have been pushing for an increase in the H1B Visa  cap and making it dynamic, i.e., if the number of petitions increase, the cap for the next year should be increased accordingly. Finally this year, the US Senate has drafted a bill to this effect and if it gets passed, the Visa cap will increase significantly. It also contains many Green Card related modifications.Last year (2022) the Visa cap got exhausted in June.
How can I apply for an H3 visa to America?
The H-3 visa cannot be initiated by the applicant, just like other H visas. The applicant has to find the appropriate training program and apply to be admitted. The institution where the training program is being held should then initiate the H-3 visa process. The institution should then petition to the appropriate agencies for the H-3 applicant to be given a visa. The institution that gives the training should send a petition to USCIS with the description of the training or special education program that the applicant wants to attend and also attach more documentation such as:The staff of the training institutionThe profile of the applicant with details about:Education and previous degreesPrior trainingWork experience in the relevant field that the training will be aboutWhether the applicant will receive any financial benefit from the trainingIf it is a special education institution, it should also prproof that they offer such services or trainingIn addition to all this, the institution should file Form I-129, Petition for Nonimmigrant Worker to USCIS. The fee for the document is $460. This document should be filled with the necessary information and sent to USCIS with the documents described above. The petition should be filed at a specific time, mainly more than six months before the training program will begin. This is because it will take time for it to process, and if filed later, USCIS cannot guarantee the processing of the petition and the communication of a decision. After USCIS reviews the documents and the Form I-129, they will make a decision and send it to the training institution. If they approve the petition, they will send Form I-797 to the institution, which will help the participant to apply for the visa. The approval of the petition will signal the training or special education participant to start applying for the H-3 visa. The visa application should be done at the U.S Embassy of the applicant’s home country. The applicant should submit these documents:Fill out Form DS-160 onlineForm I-129 and Form I-797Valid passportBirth certificateOne photograph meeting the Digital Image RequirementsDocuments which prove your intent to return to your home country such as a property deed, apartment lease, or future job contractPay the application fee of $190After submitting the documents, you will have to set an interview appointment. The interview will then be conducted to assess whether you are fit to attend the training or special education program and if you meet all the qualifications.
