It is a complicated process but here I will highlight the main steps in an informal way and which is relevant to Indians having a job offer in USA.First and foremost your employer files the petition. Thus, if you change your job, your new employer has to file a new petition for you. The US Citizenship and Immigration Services (USCIS) asks for your role and date of joining from the employer.The employer has to file the Labor Certification Application (LCA). In this, they have to basically state they will premployees on H1B the same compensation and benefits as other employees.Once the LCA is approved, the Department of Labor returns a certified copy to the employer.After this your employer files the H1B petition. For this it requires all the information regarding your education, memberships, community services,etc. Here the employer includes the fees and form I-129.After this you have to wait for the petition to be approved.This may take a long while depending upon the employer. If the employer pushes hard, it could take less time. Also here is where premium processing comes into play. The US government charges an additional $1,225 for premium processing in which case the petition has to be processed within 15 days. After this I got a mail which said:"Hello Abhik,Great News! The H-1B petition filed by Microsoft on your behalf has been approved! "At this point you should be pretty confident of getting your Visa. Once the petition is approved by USCIS, an approval notice, form I-797 is issued to the employer. This contains the time period of validity of the H1B visa, i.e., how long you can work in USA. (It is typically 3 years and can be renewed.)After this you just have to apply to one of the US embassies in India for an interview date. For this you need to fill a form called DS-160 and pay the interview fees. After this your passport is stamped with the H1B Visa,The Visa cap is fixed for every country. It is given out in a first come first serve basis. Many companies, most notably Microsoft have been pushing for an increase in the H1B Visa cap and making it dynamic, i.e., if the number of petitions increase,the cap for the next year should be increased accordingly. Finally this year, the US Senate has drafted a bill to this effect and if it gets passed, the Visa cap will increase significantly. It also contains many Green Card related modifications.Last year (2022) the Visa cap got exhausted in June.
