How long will it take to approve our petition paper filed by my US citizen husband to me and my 4 minor-aged children on October 31, 2022. Our form I-797C have been received already. What will be the next steps?
The Form I-797C is the form the USCIS sends to the applicant which might contain one or more responses.receipt of your applicationappointment for interview, fingerprinting, or additional submissions.I would guess from your question that it is in response to your husband filing a Form I-130 for you to immigrate. But he could have also filed in addition for a K-3 visa (spousal visa) for you, which is a temporary visa that allows you to come to the US while your permanent immigrant visa is processing. A K-3 visa usually takes about 90 days, while the permanent visa can take about a year.Your husband would also have to file Form G-325 • one for him and one for you, which are background forms. And he would file Form I-134, which is a statement of financial support. If either of you have been previously married, then a copy of your permanent divorce decree(s) has to be included with the Form G-325.If your kids are by him, and he was a US Citizen at the time they were born, then they would likely have US Citizenship at Birth, and should have a US ConReport of a US Citizen Born Abroad. They would not go through the immigration process • they would be immediately eligible for a US Passport to travel on.However if some of them are just your kids (he is the stepfather) then they need to be processed with your immigration application. And your husband could request a K-4 Visa for them.Assuming all the above has been adequately filed, then the next step is US approval (really a “no objection”), which then is sent to the US Embassy (or US ConOffice) serving your country for further processing.When that happens you will get another Form I-797C from the US Embassy notifying you of appointments for a medical exam and an interview. There are also some forms you should fill out (or your husband should fill out for you) • Form DS-156 and a Form DS-157.There is a fee to be paid to the US Embassy, which is recorded on the DS-156. You can download the form from the internet. Usually you can only pay this at certain banks • and the bank stamps the receipt of payment right on the Form DS-156.You have to submit the Form DS-156 with the payment receipt stamped on it when you go for your medical exam.You may or may not need the Form DS157 • but the safe thing to do is fill it out. It is a short form.Once your medical exam is completed, the Medical office will bundled up all your forms, and your passport(s) and seal them in a big envelope • which you take to the US Embassy for further processing. Do not open that envelope - hand it over to the US Embassy intact.From there you will be waiting for an interview. This is the final approval step for your visa.
