Can an H-1B visa be transferred to a new employer if the individual?
A H1B Transfer is nothing but a new H1B petition, it will be reflecting a change in employment, sometimes with a request to extend the H1B status. There is nothing that transfers from one employer to the other. It is just that you are cap exempt and need no go thru the lottery process again. So , yes your new employer can file for a new petition (a transfer) and USCIS will approve or reject it. Note: This is not a legal opinion.
